You can apply to the Family Court for a divorce if you’ve been married or in a civil partnership for a year or more. From 6 April 2022, a ‘no fault’ divorce system replaced the old procedure. That means you no longer need to provide a reason for the breakdown of the marriage, or place blame on either party. Instead, you simply present the court with a statement that confirms your marriage or civil partnership has broken down irretrievably.

The whole process takes around 6-8 months, but it’s usually sensible to hold off finalising the divorce until the finances have been dealt with. If these are complex and you are struggling to reach an agreement, delaying the process is often the best option. However, you may still be able to make a financial claim on your partner even once you have divorced.
